These Terms of Service ("Terms") govern your access to and use of Transactional Pro ("we," "us," or "our"), a transactional email API service. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
To use our services, you must create an account by providing accurate and complete information. You may register using your email address and password, or through Google OAuth. You are responsible for:

You agree to use Transactional Pro only for lawful purposes and in compliance with all applicable laws, including but not limited to CAN-SPAM, GDPR, CASL, and other anti-spam and data protection regulations. The API is intended for transactional and application email. You must not:
We reserve the right to suspend or terminate accounts that violate this policy, with or without prior notice. High bounce rates or complaint rates may also result in account suspension to protect our sending infrastructure.
You retain full ownership of the recipient data and message content you submit through our API. You are the data controller and are solely responsible for:
We act as a data processor on your behalf and will process recipient data only as necessary to provide our services.
You must verify any domain you send from by publishing the required SPF, DKIM, and DMARC DNS records. You must own or have authorization to use any domain you add to our platform. We reserve the right to remove domains that fail verification or are associated with abusive sending behavior.
You purchase email credits in advance. 1 credit entitles you to send one email. Credits do not expire and remain in your account until used. Credit purchases are non-refundable except where required by applicable law or as set out in our Refund Policy.
All payments are processed by Paddle, which acts as our Merchant of Record. Paddle handles billing, invoicing, sales tax, and refunds. By making a purchase, you also agree to Paddle's terms of service. We do not store your payment card details.
One credit is deducted for each email accepted for delivery by the API. You must have sufficient credits to send; if your balance is insufficient, the API request will be rejected and no email will be sent. Once an email has been accepted and sent, the corresponding credit is consumed even if the message later bounces.
Our platform can optionally insert a tracking pixel and rewrite links in your emails to provide open and click tracking, and delivers delivery, bounce, and complaint events to your configured webhook endpoints. This data is collected to generate logs and analytics. You are responsible for disclosing the use of email tracking to your recipients where required by applicable law. Logs and analytics are available for the lifetime of your account and are deleted upon account termination.
To protect deliverability for all users, our platform automatically manages suppression based on SES feedback:
You must not attempt to send to addresses that have been suppressed due to bounces or complaints.
The Transactional Pro platform, including its design, code, API, features, and branding, is owned by us and protected by intellectual property laws. You retain ownership of the content you submit, including message content, images, and recipient data.
You grant us a limited license to use your content solely for the purpose of providing our services (such as rendering and delivering emails). This license terminates when you delete the content or close your account.
We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend the platform or API for maintenance, updates, or circumstances beyond our control. Email delivery is provided via Amazon SES, and delivery times and rates depend on factors including recipient mail servers, content quality, and sender reputation. We do not guarantee specific delivery rates or inbox placement.
To the maximum extent permitted by law, Transactional Pro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of data, or business interruption arising from your use of our services.
Our total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, particularly the Acceptable Use policy. Upon termination:
You agree to indemnify and hold harmless Transactional Pro and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform or API, your violation of these Terms, the content of your emails, or your violation of any applicable laws or third-party rights.
We may modify these Terms at any time. When we make material changes, we will notify you by email or through a notice on our platform at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the service and close your account.
